Art. 3997 Modification or termination of emancipation

If a minor has been declared emancipated by a court, or has limited emancipation through a notarized document, that status is not always permanent. A judge can change or cancel it later if there is a good reason to do so.

Either the court on its own, or any person who has a valid concern, can ask for this change. The person making the request needs to show good cause, meaning they need a solid reason why the emancipation should be modified or ended.

This rule gives courts a way to fix or undo an emancipation decision if circumstances change or if keeping it in place no longer makes sense. It protects both the minor and others involved by allowing the court to step back in when needed.
