Art. 4203 Compelling tutor to account

If a tutor (the person managing a minor's money or property) fails to file the yearly financial report the law requires, the undertutor must step in. The undertutor's job is to watch over the tutor and make sure they are handling the child's money and property properly.

When this happens, the undertutor needs to ask the court to order the tutor to file that missing account. This doesn't only apply to the yearly report. If something else comes up that suggests the tutor should explain how they're handling the child's assets, the undertutor can also ask the court to require an accounting at that time.

This rule exists to protect children who have property or money being managed by someone else. It gives the undertutor a clear duty to act, rather than just an option, whenever there's a reason to believe the tutor isn't keeping proper records or reporting as required.
