Art. 428 No abatement on death of party

If someone involved in a lawsuit dies, the case does not automatically end. The lawsuit can keep going even after that person's death.

There is one exception to this. If the case is about a right or duty that only applied to that specific person (something strictly personal to them), then the case may end when they die. But for most other cases, the death of a party does not stop the legal process. The case continues, usually with someone else stepping in to represent the deceased person's interests, such as an executor or heir.
