Art. 4610 Opposition to homologation

If you disagree with how property or assets are being divided in a partition, you can file an opposition with the court. You can do this any time before the court gives final approval, called homologation, to the partition plan.

If nobody files an opposition, the court can move forward with approving the partition. But it has to wait at least ten days after the other side was formally notified (served with a rule to show cause) before it can give that approval. This waiting period gives everyone a fair chance to speak up if they have a problem with how the property is being split before it becomes final.
