Art. 697 Subrogor and subrogee

When someone steps into another person's shoes to collect a debt or enforce a right (this is called subrogation), the rule explains who can bring that claim to court.

If only part of the right was transferred to the new party, both people must be involved in the lawsuit. This means the original person (the subrogor) and the new party who received the right (the subrogee) both need to take part in enforcing the claim.

If the entire right was transferred, then only the new party (the subrogee) needs to bring the lawsuit. The original person is no longer part of the picture because they gave up the whole right, not just a portion of it.

This rule matters because it determines who has legal standing to sue. If the wrong parties are listed on a claim, it could cause delays or problems with the case moving forward.
