Art. 698 Assignor and assignee

When someone assigns a right to another person (like transferring the right to collect a debt or payment), this rule explains who can take that right to court.

If only part of the right was transferred, both the original owner (assignor) and the person who received it (assignee) need to be involved in the lawsuit. Neither one can handle it alone, since they each still have a stake in the outcome.

If the whole right was transferred, only the person who received it (assignee) can bring the case to court. The original owner no longer has any legal interest in it, so they don't need to be part of the lawsuit.

This matters because it determines who has the legal standing to sue. If the wrong person files the case, or if someone who needs to be included is left out, it can cause delays or problems with the lawsuit moving forward.
