Art. 736 Person doing business under trade name

If you're suing a business that's run under a trade name (like "Bob's Auto Repair" instead of the owner's actual name), you sue the person who owns and operates that business. The trade name itself isn't a separate legal entity you can sue. Instead, the actual person behind the business is the one who answers for any obligations or debts connected to that business.

This matters because it tells you who to name in your lawsuit. If someone owes you money or broke an agreement connected to their trade-name business, you name the individual who runs the business as the defendant, not just the made-up business name.
