Art. 737 Partnership; partners

If you want to sue a partnership, you can do it using the partnership's own name. You don't need to list out every individual partner to bring a lawsuit against the business.

There's also a key protection for partners here. If someone wants to sue individual partners over a debt or obligation that belongs to the partnership, they can't just go after the partners alone. The partnership itself has to be named as a defendant in the lawsuit too. This means creditors or others with claims can't skip the partnership and jump straight to suing the people who own it.

In short, this rule sets up a clear order: the partnership stands as its own legal entity that can be sued directly, and any claims against partners for business debts must include the partnership in the case.
