Art. 78 Action against partners of existing partnership

If you want to sue a partner over something the partnership owes, or over an obligation that came from the partnership's business, you need to file that lawsuit in a parish where it would be proper to sue the partnership itself. In other words, the location for suing an individual partner follows the same venue rules that apply to the partnership as a whole.

There's one exception to this. Article 79 covers a different situation and provides its own venue rules, so this general rule doesn't apply when Article 79 kicks in.

For anyone involved in a partnership dispute, this means you can't just pick any courthouse to file a case against a partner. You have to look at where the partnership itself could properly be sued, and file there instead.
