Art. 821 Rules of Chapter applicable to district courts; rules of other appellate courts applicable

If someone dies or a party needs to be replaced while a case is on appeal from a justice of the peace or city court to a district court, the district court follows the same substitution rules used in regular district court cases (found in Articles 801 through 807). This keeps the process consistent no matter where the case started.

If the case is already at the Louisiana Supreme Court or a Court of Appeal, though, those courts use their own rules for substituting parties instead. So the higher up the case goes, the more it follows that specific court's own procedures rather than the standard district court rules.
