Art. 856 Same; fraud, mistake, or condition of the mind

When someone files a lawsuit claiming fraud or mistake, they can't just make a vague accusation. They have to spell out the specific details of what happened, like who did what, when, and how the fraud or mistake occurred. Simply saying "the other side committed fraud" isn't enough to meet this standard.

However, this rule works differently when it comes to a person's mental state. If a lawsuit needs to address whether someone acted with malice, intent, knowledge, or some other state of mind, the person filing the case doesn't need to give detailed proof upfront. They can state these things in a general way, without laying out every specific fact.

The reason for this difference makes sense. Facts about fraud or mistake are things you can usually point to and describe. But you can't always know exactly what was going on inside someone else's head, so the law allows more general statements about intent or knowledge. This gives people a fair chance to bring their case forward while still requiring real detail where detail is possible to provide.
