Art. 360 Hearing

If someone files a writ asking the court to look into why a person is being held in custody, the court has to hold a hearing at the date and place already set for this purpose. At that hearing, the judge listens to the evidence and arguments from both sides. This includes the person who is being held and the person or agency holding them (the custodian).

The hearing must happen in open court, meaning it's public and not done behind closed doors. It doesn't matter if the court is normally in session or not. The judge can hold this hearing during regular court sessions, during a break in the court's schedule, or even on a legal holiday. The point is to make sure the case gets heard quickly, without unnecessary delay caused by the court's calendar.
