Art. 361 Custody without court order

When someone is being held in custody without a court order behind it, the judge has to decide what happens next after holding a hearing. The judge will look at the facts and decide whether to let the person go free or keep them in custody.

There's no fixed rule that says the person must be released or must stay held. Instead, the judge makes this call based on what seems fair and right given the situation. This gives the judge flexibility to sort out cases where someone is detained without the usual paperwork or court order backing up why they're being held.

The main point is that nobody should be stuck in custody indefinitely just because there wasn't a formal court order. The hearing gives the person a chance to have a judge actually look at their situation and make a real decision about whether holding them makes sense.
