Art. 368 Disobedience of writ or judgment; contempt

If someone doesn't follow a court order connected to a habeas corpus case, they can be held in contempt of court. This applies in two situations: when a person ignores the actual writ (the court's initial order telling them to bring a person before the court or explain why they're being held), or when they ignore the final judgment the court makes after reviewing the habeas corpus petition.

In simple terms, habeas corpus is a legal tool used to challenge whether someone is being held or detained legally. If a court gets involved and issues an order in one of these cases, that order has to be followed. This might apply to a jailer, a warden, or anyone else who has custody over the person involved in the case.

If the person or official in charge doesn't do what the court tells them to do, the court can punish them for contempt. This could mean fines or other penalties, depending on how the court decides to handle it. The point of this rule is to make sure court orders in habeas corpus cases aren't just ignored, since these cases often deal with someone's basic right to freedom.
