Art. 367 Rearrest after discharge

If someone is released from jail through a habeas corpus case, that release does not give them permanent protection from arrest. Police can still arrest them again later if there is a valid legal reason to do so.

In other words, winning a habeas corpus case only deals with the specific problem that made the first arrest or detention illegal. It does not make someone immune from future arrest. If new evidence comes up, a new charge is filed, or another lawful reason to arrest the person exists, law enforcement can take them into custody again.
