Art. 583 Interruption of time limitation where new trial

When someone gets a new trial (either because a judge granted one or an appeals court sent the case back), the state normally has a set amount of time to actually hold that new trial. This rule explains what happens when something interrupts that deadline.

If one of the situations listed in Article 579 happens, like the defendant hiding from the court, fleeing the state, or otherwise causing delays, the clock on the time limit stops running. It doesn't just disappear though. Once whatever caused the delay is resolved, the state gets a fresh one year period to bring the case to trial again.

In simple terms, this rule stops defendants from using delay tactics to run out the clock and get their case thrown out. If a defendant causes the holdup, they can't later argue the state waited too long once things get back on track.
