Art. 591 Double jeopardy; definition

This rule protects people from being tried twice for the same crime. Once someone faces trial for an offense, the government generally can't try them again for that same offense. This protection is meant to stop the state from repeatedly trying to convict someone until it gets the result it wants.

There are some exceptions to this rule, though. If the defendant asks for a new trial themselves, or if a judge sets aside a conviction after the defendant requests it, a second trial can happen. This makes sense because the defendant is the one choosing to go through the process again, usually to fix a problem with the first trial.

A second exception involves mistrials. If a judge declares a mistrial for legal reasons spelled out in the law, or if the defendant agrees to a mistrial, then a new trial can move forward. In these situations, the case didn't reach a real conclusion the first time, so trying again doesn't count as being tried twice for the same crime. The key idea is that double jeopardy protection kicks in when the state tries to punish someone twice against their will, not when the defendant has a hand in restarting the process.
