Rule 8.1 Traversal of In Forma Pauperis Status

If someone in a court case is allowed to move forward without paying court costs because they can't afford them, this is called being "in forma pauperis." This rule says the court, or the other side in the case, can question whether that person really qualifies for this financial break.

If a challenge is made, the court can hold a hearing to look closer at the person's finances. At the hearing, the judge decides if the person truly cannot afford the costs. If it turns out they can actually pay, the judge can take away their in forma pauperis status and require them to pay the normal court fees.

This rule exists to make sure only people who genuinely cannot afford court costs get to skip paying them. It gives the court and other parties a way to check that this benefit isn't being misused.
