Art. 303 Conclusive presumptions

Some legal presumptions can't be argued against, no matter what evidence you bring to court. These are called "conclusive presumptions," and they work differently from the other presumptions covered in this chapter of evidence rules.

This rule basically says that conclusive presumptions aren't part of the evidence rules at all. Instead, they're treated as part of the actual law itself. This means courts don't weigh evidence for or against these presumptions like they do with other legal assumptions. Once a conclusive presumption applies to your case, the outcome is settled on that point, and no amount of proof can change it.

For example, if a law says a child under a certain age is presumed unable to give legal consent, that's treated as a fixed legal fact, not something you can challenge with witnesses or documents. The rule simply makes clear that these kinds of unchallengeable presumptions come from other laws, not from the evidence code itself.
