VI § 1 Cases Not Eligible for Oral Arguments

If you're asking the Louisiana Supreme Court to take a second look at a case or review a lower court's decision, you won't get a chance to argue your point in person. This applies to three specific situations: asking the court to reconsider a decision it already made (a rehearing), asking the court to review a court of appeal's ruling (a writ of review), or asking for emergency or special court action (a supervisory or remedial writ).

In all three cases, the court will only look at the written documents you file. There's no hearing where lawyers stand up and speak to the justices. This means everything you want the court to know has to be in your written filing, because that's the only chance you get to make your case.

This rule helps the court move through a large number of requests efficiently. Since many people ask for rehearings or writ reviews, allowing oral arguments for all of them would slow down the court significantly. Instead, the justices read the papers filed and make their decision based on that alone.
