XI § 2 Court Discretion and Docketing

This rule deals with cases where a federal court sends a legal question to the Louisiana Supreme Court for an answer. This usually happens when a federal court needs guidance on how Louisiana law applies to a case it's handling. The Louisiana Supreme Court gets to choose whether it wants to answer that question at all. It is not required to take every question that comes its way.

If the Court decides to accept the question, the case then moves forward like other cases before the Court. It gets scheduled for oral arguments, and both sides will need to submit written briefs. The Court tries to get these cases on the calendar as soon as it reasonably can, since federal courts are usually waiting on the answer to move forward with their own case.

For people involved in a lawsuit, this means there's no guarantee the state Supreme Court will weigh in on a tricky legal question, even if a federal judge asks for help. But if the Court does agree to answer, the process moves at a good pace so the underlying federal case isn't stuck waiting too long.
