XIII Rule XIII

If a person involved in a case before the Louisiana Supreme Court dies or needs to be replaced for some other reason, the court follows the same steps laid out in Articles 801 through 807 of the Louisiana Code of Civil Procedure. This means the Supreme Court doesn't have its own separate process for swapping in a new party. It just uses the standard rules that apply in other Louisiana courts.

In practice, this matters most when someone dies while their case is still waiting on a decision. The rule makes sure there's a clear legal path to bring in the right person, like an estate representative or an heir, so the case can keep moving forward instead of getting stuck. If the law changes these underlying articles in the future, those updated rules automatically apply here too.
