Rule 23 Attorney Transferred to Disability Inactive Status Not Permitted to Practice Law

When an attorney is placed on disability inactive status, they lose the right to practice law right away. They cannot see clients, give legal advice, represent anyone in court, or do any other legal work while they are on this status.

The only way an attorney can start practicing again is if the Court issues an order allowing them back. This means the attorney has to go through a formal process and get official approval before they can pick up their legal work again. Simply feeling better or believing they are ready to return is not enough. There must be a court order restoring their right to practice.

This rule exists to protect clients and the public. It makes sure that someone who was found unable to practice law safely does not go back to work until a judge confirms they are fit to do so again.
