Rule 5.10 Writ of Certiorari

Writ of certiorari is a way to ask a higher court to review a lower court's decision. Whether you can use this option depends on what the Mississippi Constitution and state laws allow, not on this rule alone.

Once the lower court sends up its official record after the writ is granted, the case moves forward just like a regular appeal. This means the higher court will look at what happened in the original case, based on the written record, rather than starting the case over from scratch.
