Rule 4:12-1 Within the State

When someone takes a deposition in New Jersey, a qualified person must be present to officially swear in the witness. This person administers the oath, which means they formally ask the witness to promise to tell the truth.

Common examples of people authorized to do this in New Jersey include notary publics and court reporters who are certified to give oaths. You cannot just record someone's answers without having this authorized person present.
