Rule 4:12-2 Without the State but Within the United States

If you need to take a deposition outside of New Jersey but still within the United States, you need the right person to oversee it. That person must be legally allowed to give oaths, meaning they can officially swear in the witness before questioning begins.

The person running the deposition can be authorized under New Jersey law, federal law, or the law of whatever state the deposition takes place in. This gives you some flexibility in finding the right person for the job, such as a notary public or other authorized official.
