Rule 4:42-5 Effect of Judgment for Possession

If you win a court case giving you the right to take back your property, that victory does not end your legal options. You can still go to court again to seek money from the other person.

In that second case, you can ask for "mesne profits," which is money the other person made or should have paid while they were wrongfully occupying your property. You can also ask for other damages caused by their unlawful possession.

This right also passes to your personal representative, meaning that if you die after winning the possession case, someone handling your estate can still bring the money claim on your behalf.
