If you get an order from a district court saying your arrest record should be expunged, this rule explains what happens next at the appellate court level. Expungement means clearing or sealing your arrest record so it's no longer part of the public record.

Once the appellate court receives the district court's order, the court will look it over and remove the records covered by that order, as long as it's appropriate to do so. This applies specifically to arrest records and other public records that the appellate court keeps on file, under New Mexico's Criminal Record Expungement Act.

In simple terms, this rule makes sure that when a judge approves your request to clear your record, the appellate court follows through and actually removes those records from its own files too, not just at the district court level.
