§ 1041 Required findings concerning notice

Before a judge can hold a factfinding hearing in a child abuse or neglect case, the court has to make sure proper notice was given. This means the judge must confirm one of two things happened.

First, the judge can check that the parent or other person responsible for the child is actually at the hearing and got a copy of the petition (the document that explains what the case is about). If that person is there and was properly served, the hearing can move forward.

If the parent or responsible person is not present, the judge must find that real, honest efforts were made to give them notice. This means someone tried the proper legal ways to reach them and let them know about the case, even if those efforts did not succeed in getting the person to show up.

This rule exists so that no one loses custody or has other big decisions made about their child without at least a fair chance to know about the case and show up. The court cannot skip this step and just start the hearing without making sure notice was handled properly.
