§ 411 Jurisdiction

When someone needs help getting child support or spousal support in New York, the family court is the only court that can handle that case from the very beginning. This applies to regular support cases, as well as cases that cross state lines under a law called the Uniform Interstate Family Support Act. This law helps make sure support orders can be created and enforced even when the parents live in different states.

While handling a support case, the judge has another power too. If the judge sees signs that a child might be neglected, the judge can order a neglect case to be started on their own, without anyone asking for it. This means the court can step in to protect a child even if the original case was only about money.
