§ 430 Temporary order of protection

When someone files a family court petition, the judge can issue a temporary order of protection right away if there's a good reason for it. This order can include the same kinds of protections found in a final order, like keeping one person away from another or setting rules about contact.

It's important to understand that a temporary order of protection is not a decision about who did anything wrong. The court hasn't ruled on the actual case yet. This order is just a safety measure put in place while the case is still being sorted out.

The judge can issue this temporary order without notifying the other person first, or after giving notice, depending on the situation. In some cases, the judge may also issue a warrant at the same time, ordering the police to arrest the other person and bring them to court. This can all happen quickly, often before the person the order is against even knows a case has been filed.
