§ 441 Order dismissing petition

If a support case goes to court and the person asking for support can't prove their claims with solid evidence, the judge has to throw out the case. The court can't order support payments just because someone asked for them. There has to be real proof backing up what's being claimed.

There's one important exception. If a neglect case was also filed alongside the support case, the judge can still handle the neglect case even after dismissing the support request. So dismissing the support petition doesn't automatically end everything. The neglect claim can move forward on its own, separate from what happened with the support request.

This means two things can happen at once in the same case. A parent might not get the support order they wanted, but a related neglect concern can still be looked at and decided by the court. The two issues are treated separately, even though they started in the same proceeding.
