§ 528 Procedure before court

When someone is brought before a judge under this part of the law, the judge has two options. The judge can let the person stay free by requiring them to promise (in a formal way) that they will come back to court when needed. This promise is often backed up with money or a bond, similar to bail.

If the person cannot or will not make this promise, the judge can order them to be held in custody instead. This means they would stay in jail or a detention facility until their next court date, rather than being released.

In short, this rule gives the judge the power to decide whether someone can go free while their case moves forward, based on whether they can guarantee they will return to court.
