§ 562 Proceedings to compel support by mother and father

This law lets a court order both parents to financially support their child when the father does not dispute that he is the child's father. If paternity is not being contested, the case can move forward as a regular child support matter under article four of the Family Court Act.

This process does not apply if the parents have already worked out an agreement or settlement under section 517. In that case, the separate agreement takes the place of a new court support proceeding. This rule basically clears the path for straightforward support cases when there is no fight over who the father is.
