§ 580-306 Inappropriate tribunal

If you file a support case in the wrong New York court, that court won't just reject your paperwork and leave you stuck. Instead, the court has to send your petition and any related documents to the correct court, whether that's a different court in New York or a court in another state.

The court also has to tell you what happened. You'll be notified about where your paperwork was sent and when it was sent there. This way you know where your case is headed and can follow up with the right court.

This rule exists so people don't lose their chance to get support just because they filed in the wrong place. Instead of starting over from scratch, your case gets redirected to where it needs to go.
