§ 581-204 Judgment of parentage for intended parents who are spouses

If you and your spouse used a surrogate to have a child, you can get a court judgment that legally names both of you as the child's parents. This gives you a clear legal document proving parentage, even though the law already assumes certain parentage rights for married couples in other situations.

You don't have to be married to get this kind of judgment together. Two people who are not spouses can still go to court and be named as the joint legal parents of a child born through surrogacy. Marriage is not a requirement for this process.
