§ 581-602 Health and welfare decisions

Here's a plain English summary of this rule:

If you are acting as a surrogate, you get to make your own decisions about your health and your pregnancy. Nobody else gets to make these choices for you, including the parents who will raise the child.

This means you decide whether to have a C-section. You decide which doctor or midwife you want to use. You also decide whether to continue the pregnancy or end it, and whether to reduce the number of embryos or fetuses if there is more than one. These are personal medical decisions that belong to you alone.

The point of this rule is to protect the surrogate's control over her own body during the pregnancy. Even though the surrogate is carrying a child for someone else, she does not give up her right to make medical choices about her own health and pregnancy.
