§ 632 Order dismissing petition

If a parent, agency, or other party brings a case under this part of the law and the court finds there isn't enough proof to back up the claims in the petition, the judge has to dismiss the case. In other words, if the person who filed the petition can't show solid evidence for what they're claiming, the case gets thrown out.

The second part deals with a more specific situation. Sometimes during these cases, someone asks the court to look again at an earlier decision about where a child was placed or who has custody. This rule says that even if the judge dismisses the main petition, the court can still go ahead and rule on that separate request to reconsider. The judge doesn't lose the power to decide that issue just because the original case got dismissed. This can happen either because someone asked for it or because the judge decides to review it on their own, as long as everyone involved is told about it first.
