§ 723 Duties of private person before and after taking into custody

If a private citizen (not a police officer) takes someone into custody under this law, they have to follow certain steps.

Before taking the person into custody, the private citizen must tell them why they're being taken into custody. They also have to give the person a chance to go along peacefully instead of using force right away.

After taking the person into custody, the private citizen can't just hold onto them or waste time. They need to act quickly and do one of a few things: take the person home, bring them to a family court judge, or hand them over to a police officer or peace officer who is on duty.

This rule exists to protect people from being held longer than necessary by someone who isn't a police officer. It makes sure the person taken into custody gets to a proper authority fast, instead of being kept by a private citizen without any real oversight.
