§ 102 Application of CPLR and other laws

When you're dealing with the Surrogate's Court (which handles things like wills, estates, and guardianships), the same general court rules that apply everywhere else in New York also apply here. These general rules come from something called the CPLR, which is the main rulebook for how civil cases work in New York courts.

The Surrogate's Court doesn't have to reinvent every rule from scratch. Instead, it borrows from the standard playbook unless there's a specific reason to do things differently. If the Surrogate's Court Procedure Act itself lays out a special rule for a certain situation, that special rule wins. But if the Act stays silent on something, the court falls back on the regular CPLR rules or other applicable laws.

In practical terms, this means lawyers and people involved in estate or guardianship cases can rely on familiar court procedures in most situations. You don't need a completely different set of rules just because you're in Surrogate's Court. The only time things change is when this specific Act says otherwise.
