# Rule 48: Dismissal

This rule covers two ways a criminal case can be thrown out before it's finished.

The first way happens when the prosecutor decides to drop the charges. The prosecutor needs the judge's permission to do this, but once that permission is given, the case is over. This can even happen in the middle of a trial, and the defendant doesn't get a say in whether the prosecutor drops the charges.

The second way happens when the court itself steps in because of delays. If someone has been charged with a crime but the government takes too long to file formal charges, or takes too long to actually bring the person to trial, the judge can dismiss the case. This protects people from sitting around for months or years waiting for their case to move forward. The government is expected to act within a reasonable amount of time, and if they don't, the case can be dismissed as a result.
