Rule 1104 Effective Date

This rule explains how and when these evidence rules officially start being used in court. After the rules are given to the leaders of the Senate and House, they automatically take effect 60 days later, unless a majority of either the Senate or the House votes against them. If the rules do get approved this way, the exact start date gets written on the official document.

Once these rules take effect, they apply to any new case filed after that date. They also apply to cases that are already in progress. The only exception is if using the new rules would be unfair or impossible to apply to a case that is already underway. In that situation, the older evidence rules would still apply instead.

The note at the end simply points out that this rule works the same way as an earlier version, but not everyone on the committee agreed with adopting it.
