Rule 13 Investigator’s Recommendations Report

(a) Filing. Upon completing their investigation, the Investigator shall promptly file with the Clerk of the Supreme Court an original copy of recommendations, findings, and conclusions. The report shall remain confidential until formal charges are filed. The report shall state the laws, canons, and/or rules allegedly violated pursuant to Rule 4 and the alleged facts upon which such charges are based in ordinary and concise language. The report shall also be served on the Subject Judge. The Investigator may redact certain information from the report if such information is privileged or confidential.
(b) Content. The Investigator, in their report, may recommend any of the following actions:
(1) Dismissal of the complaint;
(2) Private admonition or deferred discipline agreement, which must be consented to by the Subject Judge;
(3) Filing of formal disciplinary charges and holding a hearing to decide them; or
(4) Professional counseling or assistance for the judge.
(c) Filing of Transcript and Costs. Within a reasonable time after filing the recommendations report, the Investigator shall file with the Clerk of the Supreme Court any transcripts, any evidence, and a memorandum of costs of service of process, witness fees and expenses, mileage, depositions, and investigation expenses.
