Rule 4 Grounds for Discipline

(a) In General. Grounds for judicial discipline shall include:
(1) Willful misconduct in office, including misconduct which, although not related to judicial duties, brings the judicial office into disrepute or is prejudicial to the administration of justice;
(2) Willful or persistent failure to perform judicial duties, including consistent failure to make decisions in a timely manner and incompetent performance of judicial duties;
(3) Habitual intemperance, including drug or alcohol abuse;
(4) Disability seriously interfering with the performance of judicial duties, whether temporary or of a permanent condition1;
(5) Rendering findings of fact or legal conclusions based on fraud, corrupt motive, or bad faith; or
(6) Any conduct that violates the NMI Code of Judicial Conduct.
(b) Failure to Cooperate. Failure or refusal of a judge to cooperate, or the intentional misrepresentation of a material fact during any stage of a disciplinary proceeding may constitute willful misconduct in office.
