Rule 2 Suspension of Rules

The Supreme Court has the power to set aside its own rules for a specific case. This can happen either because the judges decide to do it themselves, or because one of the parties involved in the case asks for it. The Court might do this to speed up a decision or for any other good reason.

If the Court decides to suspend a rule, it can then set up its own special instructions for how the case should move forward. This gives the Court flexibility to handle unusual situations that the standard rules might not cover well.

There is one limit to this power. The Court cannot suspend the specific rule covered under Rule 26(b), no matter the circumstances. That one exception stays in place even when other rules can be set aside.
