Rule 1-1 Authority; Forms; Definitions
Article I: Applicability of Rules

(a) Authority. These rules are promulgated pursuant to Article IV, Section 9(a) of the NMI Constitution.
(b) Forms.
(1) The Court maintains all forms in the appendix and may modify them at any time without notice.
(2) Use of the forms in the appendix is not required. If another document is used in place of a corresponding form in the appendix, the document must clearly indicate what it purports to be and must convey the information requested by the form.
(c) Definitions. The following definitions apply throughout these rules unless the context clearly indicates otherwise:
(1) “Business days” means Monday through Friday, excluding legal holidays.
(2) “Calendar days” means every day, including weekends and legal holidays.
(3) “Clerk” means the Clerk of the NMI Supreme Court.
(4) “Court” means the NMI Supreme Court. A single justice of the Court may act on the Court’s behalf unless a specific rule requires action by the full panel.
(5) “File” or “filing” means electronic filing when the matter is one for which electronic filing is required. In instances where electronic filing is not required, “file” or “filing” means conventional paper filing.
(6) As used in this rule, “legal holiday” means any day on which the Court is closed pursuant to statute, executive order, court order, or public notice for any reason, including special administrative holidays, inclement weather, fiscal austerity measures, or public health measures.
(7) “Serve” or “serving” or “service” or “notice” means electronic service when the matter is one for which electronic service is required by the NMI Rules for Electronic Filing and Service. In instances where electronic service is not required by those rules, “serve” or “serving” or “service” or “notice” means conventional forms of service or notice.
(8) “Superior Court” means the NMI Superior Court.
