Rule 14.1 Expungement of Criminal Appellate Records

If you got your criminal record expunged by a district court under Oklahoma law, you can also ask the Court of Criminal Appeals to expunge related records from your appeal. This means the district court order is not the end of the process if your case was appealed. You need to take a separate step with the appeals court to clear those records too.

This matters because criminal cases often create two sets of records: one at the trial court level and one at the appellate level if the case was appealed. Clearing your record at the district court does not automatically clear the appellate records. You have to file a request with the Court of Criminal Appeals to have those records expunged as well.

To use this rule, you must already have an expungement order from a district court under Sections 18 and 19 of Title 22. Once you have that order, you can point to it when asking the appeals court to expunge the related records from your case's appeal.
