Rule 16.1 Purpose of Procedures

This rule explains how to appeal a court's decision on immunity from prosecution under Oklahoma's "Stand Your Ground" law, found in Section 1289.25(F) of Title 21. If someone claims they acted in self-defense and asks the court to grant them immunity from criminal charges, the judge will rule on that request before trial. Either side can appeal that ruling, whether the judge grants immunity or denies it.

The rule makes clear that these specific appeal procedures apply no matter what other appellate rules might normally cover the situation. In other words, this rule takes priority over general appeal rules when the case involves a pretrial immunity decision under the Stand Your Ground law. This helps make sure both the prosecution and the defense know exactly how to challenge the judge's decision if they disagree with it.
