Rule 8.2 Immediate Confinement on Refusal or Neglect to Pay Fine and/or Costs

If someone is ordered to pay a fine or court costs and a judge finds that they actually have the money to pay but simply won't, the judge can send them straight to jail. This only applies when the court has specifically determined the person is able to pay but is refusing or ignoring the order.

This rule doesn't apply to people who genuinely cannot afford to pay. It's meant for situations where someone has the money but is deliberately avoiding their payment obligation. The key factor is the judge's finding about the person's financial ability. If a judge decides the person could pay but won't, jail time can happen right away, without extra warnings or waiting periods.

This rule comes from Oklahoma law, specifically Section 983(D) of Title 22, which gives courts this power to enforce payment of fines and costs.
