Rule 8.1 Judicial Hearings

If a court orders someone to pay a fine or court costs as part of their sentence, a judge has to hold a hearing to check whether that person can actually pay right away. The judge cannot just assume the person has the money. There has to be an actual decision made in court about whether the person can pay the fine and costs immediately.

This matters because someone cannot be sent to jail simply for being unable to pay a fine. The hearing gives the person a chance to show the judge their financial situation. Based on what the judge learns, the court can decide whether to set up a payment plan, lower the amount owed, or handle the situation another way instead of demanding immediate payment.
